Trademarks
All uses of Apogee trademarks and service marks, both registered and common law, must be approved in writing by The Apogee Foundation.
Apogee is a service mark of The Apogee Foundation registered under the laws of the United States and European Union and protected under international treaties and common law throughout the world.
All of the logos, graphic designs, mottos and names of awards and programs on any of the Websites as well as other sites registered to, developed by or managed by Apogee or its affiliates are either pending trademark registration or are unregistered common-law trademarks of The Apogee Foundation.
Trademarks, service marks and logos belonging to third parties also may be displayed on one or more of the Websites. Nothing contained in any of the Websites should be construed as granting, by implication or otherwise, any license or right to use any trademarked or copyrighted materials displayed on any of the Websites without the express written permission of The Apogee Foundation and of any third party which may own such materials. Any unauthorized use of any such materials or of any other images or content on any of the Websites, except as authorized in this User Agreement, is strictly prohibited.
Copyrights
All works of authorship contained in any of the Websites, including but not limited to all design, text, graphics and images, are protected by copyright pursuant to U.S, E.U. and/or International law. No part of any of the Websites or their associated directories, files, text. pages, coding, layout or graphics may be copied, reproduced, transmitted, displayed, performed, distributed, rented, sublicensed, altered, stored for subsequent use, or otherwise used in whole or in part in any form or by any means, electronic, mechanical, recording or otherwise, without the prior written permission of The Apogee Foundation.
Materials quoted or displayed on any of the Websites in which any third parties retain rights remain the property of their respective owners. Where known to us, we attempt to identify and credit owners accordingly, and retain only our rights to "fair use" of materials under the copyright law for implementing the educational and public awareness mission of the Foundation. Any party which believes it has rights to any materials quoted or displayed on this site who wishes to assert such rights by requesting that we remove such materials should contact the Foundation and we will be glad to review, consider and act appropriately in response to such requests.
Rights of Use
Submission of any materials or information for publication on any of the Websites or otherwise for use by Aurience or its affiliates must be made and in any case shall be deemed to have been made pursuant to the terms and provisions of the Foundation's Rights of Use Form, which can be obtained on its Websites.
Please review the contents of this form carefully, as any and all materials submitted to the Foundation or to any of the Releasees (as defined in the Terms and Conditions section of the Agreement) shall be deemed to have been submitted pursuant and subject to the terms of the Material Submission Form, whether or not the person or entity making such submission has actually signed and delivered this form to the Foundation.
